Terms of Use
Version 1.0 · Published 2 October 2026
Please read these terms carefully. They are the agreement between you and Bric, and they explain what Bric is, what it is not, and who is responsible for what gets made with it.
The short version
- Bric is automated software. It generates and changes designs for physical objects and can run automated checks on them. It does not engineer, test, certify or approve anything that gets made.
- Everything Bric produces can be wrong — shapes, sizes, fit, materials, safety information and anything else — even when it looks right. You must check and test everything yourself before you make, sell or use it.
- A passed check, such as "ready to print", means only that a specific automated test found no blocking problem. It is not a promise that the object will print, work, hold weight or be safe.
- If you make, manufacture or sell a product, it is your product. You are responsible for its materials, parts, assembly, safety, compliance with the law, and what happens to anyone who uses it.
- Bric is provided as it is, without promises. Our liability is excluded or capped as far as the law allows, and you agree to cover us for claims that come from your products and your use of Bric.
- Disputes are settled individually by binding arbitration, not in court or as a class action, unless you opt out within 30 days (section 27).
This summary is to help you read what follows. It is not a substitute for it: the full text below is what applies.
1. Agreeing to these Terms
These Terms of Use (the "Terms") are a binding agreement between you and RGHL Brands Pte. Ltd., trading as Bric Lab ("Bric", "we", "us" and "our"). "Bric" also includes our affiliates, officers, directors, employees, contractors, agents, licensors and service providers, and any successor to us, wherever these Terms exclude, limit or protect liability. They govern your use of the Bric website, app, software, AI features, templates, files, content and related services (together, the "Service").
By signing in, creating an account, or otherwise using the Service, you confirm that you have read, understood and accept these Terms and any Feature Terms, which form part of these Terms, and that you have read our Privacy Policy, which explains how we handle personal information. If you do not accept these Terms, do not use the Service.
If you use the Service on behalf of a company or other organisation, you confirm that you have authority to bind it, and "you" includes that organisation. You and it are jointly responsible for complying with these Terms.
PLEASE READ SECTIONS 6 TO 14 AND 21 TO 24 CAREFULLY. THEY EXPLAIN WHAT BRIC DOES AND DOES NOT DO, PLACE RESPONSIBILITY FOR ANY PRODUCT YOU DESIGN, MAKE OR SELL ON YOU, AND LIMIT BRIC'S LIABILITY. SECTION 27 REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS.
2. Key definitions
In these Terms:
- "Your Content" means everything you submit to the Service, including descriptions, messages, instructions, pictures, sketches, files, settings, feedback, answers about whether and how you made something, and photos you add.
- "Output" means anything the Service generates or provides for you, including text, answers, briefs, pictures, geometry, 3D models, files, every build attempt (including attempts you are not shown), measurements, dimensions, part lists, bills of materials, specifications, instructions, suggestions, estimates, Automated Check results, and information taken from third-party sources.
- "Product" means any physical object, part, prototype, assembly, batch or production run that is made, or has been made, wholly or partly from or with the help of an Output — by you, or by anyone using an Output you obtained or shared — including any Third-Party Components in it.
- "Automated Check" has the meaning in section 8.
- "Third-Party Component" means any part, material, hardware, electrical or electronic component, battery, light source, motor, magnet, fastener, adhesive, finish, software or other item that the Service does not itself produce as geometry, whether or not an Output refers to it or is shaped around it.
- "Safety-Critical Characteristic" means any property of a Product on which the safety of people, animals or property depends, such as structural or load capacity, stability, electrical safety, fire safety and flammability, thermal performance, pressure safety, chemical or food-contact safety, medical or clinical performance, protective performance, child safety, and vehicle-critical performance, and any property that the law requires to be tested or certified.
- "High-Risk Use" means any making, distribution or use of a Product in which a failure, defect or inaccuracy of a Safety-Critical Characteristic could reasonably be expected to cause death, serious personal injury, serious illness, or significant damage to property or the environment.
- "Feature Terms" means additional terms we show you for a particular feature, such as the Publishing Terms.
3. Who may use Bric
You must be at least 18 years old, or the age of majority where you live if that is higher, and able to form a binding contract. The Service is not directed at children and you may not use it if you are younger.
You may not use the Service if you are barred from doing so under the laws of the United States or any other applicable country, if you are located in, or ordinarily resident in, a country or region subject to comprehensive US sanctions, or if you are on any US or other government list of prohibited or restricted parties.
Bric is currently invite-only. We decide who may join, and we may withdraw access at any time.
4. Your account
You sign in with a link sent to your email address. You are responsible for keeping that email account secure, for everything done through your Bric account, and for telling us promptly if you think someone else has used it. Do not share your account or sign-in links.
You must give us accurate information and keep it up to date. We are not liable for any loss caused by someone else using your account, whether or not you knew about it.
5. A service in development
Bric is an early, pre-release service. Features may be experimental, incomplete, change without notice, stop working, or be withdrawn. Projects, pictures, 3D models, files and other data may be lost or corrupted. We do not promise that the Service will be available, uninterrupted, timely, secure or error-free, or that any feature will continue to exist.
Keep your own copies of anything that matters to you. We are not responsible for the loss of any content, however it happens.
6. What Bric does, and what it does not do
Bric is an automated software design and creation tool. Using artificial intelligence and other software, the Service may, among other things:
- interpret your instructions and descriptions;
- generate geometry and 3D models, and modify them;
- suggest dimensions, proportions, tolerances and clearances;
- suggest materials, finishes, components or methods of making;
- run Automated Checks;
- generate files, pictures, specifications, part lists and other information; and
- assist you in preparing files for printing or manufacture.
These are automated functions. None of them, alone or together, is or includes: professional engineering or design services; professional safety analysis or risk assessment; testing of any physical object; certification or regulatory approval; confirmation of compliance with any law or standard; verification that a Product is fit for any purpose; confirmation of structural capacity, strength or durability; confirmation that a finished Product is safe; or approval of a Product for commercial sale, distribution or use.
Bric is not a licensed engineer, architect, product-safety professional, testing laboratory, certification body, manufacturer, professional design consultancy or regulatory adviser, and it does not act as one for you. Nothing in the Service is professional, engineering, legal, regulatory, safety, medical or financial advice.
Bric does not manufacture, inspect, test, certify, package, label, market, sell, import or distribute any Product, and it does not decide whether any Product is made, sold or used. Those decisions are yours alone.
7. Outputs may be wrong
Outputs are generated automatically by artificial intelligence and software, and they are probabilistic. Any Output, of any kind, may be inaccurate, incomplete, inconsistent, out of date, unsafe, impossible to make, or infringing — and Outputs can look convincing, precise and authoritative even when they are wrong. Errors may affect, among other things:
- geometry, shape and proportions;
- measurements, dimensions and scale;
- tolerances, clearances and fit;
- wall thicknesses;
- how parts relate to, connect with or assemble with each other;
- suggested materials, finishes and components;
- compatibility with any printer, material or manufacturing process;
- manufacturing information, such as part lists, specifications, quantities, costs and lead times;
- information taken from third-party sources, such as the dimensions of another product;
- safety-relevant characteristics;
- regulatory information; and
- assumptions about intellectual property.
In particular: a picture shows how something might look, not that it can be made or will look like that when made; a 3D model may not match the picture, the brief or what you asked for; a figure looked up on the internet may be wrong, out of date or misread, so always measure the real thing; suggestions drawn from many people's print results are general patterns that may not hold for your printer, material, settings or object; and two people may receive similar or identical Outputs, which are not unique to you.
8. Automated Checks
The Service may run automated computational tests on an Output (each an "Automated Check"). Depending on the feature and the Output, Automated Checks may examine conditions such as whether each part forms a closed shape; whether a part is in one piece or has disconnected pieces; the object's scale and measured dimensions compared with what was asked for; whether parts overlap or run into each other; gaps between parts meant to move; whether a part fits within a printer's build volume, where the Service knows that volume; fit around another object you have described; overhangs and orientation; and a trial run through slicing software using general settings rather than those of your own printer, material or process. Each Automated Check tests only the specific condition it is built to test, using the information available to it, and some checks run only for some Outputs.
The Service may describe results with words such as "passed Bric's print checks", "checks passed", "ready to print", "print-ready", "print files made", "checked", "passed", "closed shapes" or "fits", or say that it is checking whether something "will print". "Print-ready" is also the name Bric gives to the files it makes for printing; that name is not a statement that an object will print. Every such word refers only to the result of an Automated Check. A passed or positive result means only that the Automated Check concerned did not identify a blocking condition according to that check. It does not establish, and Bric does not represent, that:
- the object will print, or can be manufactured, successfully on any printer, material or process;
- it is manufacturable in any respect other than the specific condition checked;
- its parts will fit, assemble or work together;
- it has any strength, stiffness or load-bearing capacity;
- it is fit for any purpose;
- it is safe; or
- it complies with any law, regulation, standard or certification requirement.
Automated Checks do not assess, among other things: the actual thickness of walls; structural engineering or load-bearing capacity; impact resistance; long-term fatigue, creep or wear; thermal performance; electrical safety; fire safety or flammability; chemical safety or toxicity; food-contact safety; medical or clinical suitability; or compliance with law.
A passed Automated Check is not a certification, warranty, guarantee or professional opinion, and it does not replace physical testing or professional review. An Automated Check may itself be wrong, may not run, and may give different results for similar objects. Sections 7 and 10 apply to every Automated Check result.
9. Third-party components and finished Products
The Service may generate geometry for a whole object or for part of one — for example a lamp shade, a lamp housing, an enclosure that holds an independently sourced electrical component, furniture parts, or a housing around third-party hardware. Generating geometry around or for a Third-Party Component does not mean that Bric has designed, tested, endorsed or verified that component, or the way it is integrated into a Product. Bric does not represent that:
- any Third-Party Component is safe, suitable, genuine or compliant;
- any electrical, mechanical or other integration is safe;
- a finished lamp or other electrical Product complies with electrical rules or standards;
- furniture, a mount or any other Product can safely support any load;
- a joint, fastening or connection will withstand any force;
- any material chosen for a Product is appropriate;
- any assembly is correct; or
- any finished Product is safe.
You are solely responsible for selecting, sourcing, integrating, installing, wiring, assembling and using Third-Party Components, and for following their makers' instructions, ratings and warnings. Where an Output refers to a Third-Party Component, including its dimensions or ratings, that information is an Output and section 7 applies to it.
10. You must verify before you rely
You are solely responsible for evaluating every Output and deciding whether, and how, to use it. Before you print, prototype, order, manufacture, assemble, install, sell, distribute, give away or use anything based on an Output, you must independently verify it — and where it matters, have it reviewed by a suitably qualified professional. That includes, without limitation:
- measuring, checking and correcting all dimensions, fits, clearances and tolerances against the real parts, products and people it is for;
- choosing materials, processes and print or manufacturing settings, and checking their strength, durability, heat, chemical and UV resistance, flammability and toxicity for the intended use;
- making a physical sample or prototype and testing it properly, in the conditions it will actually be used, before any production run, batch or order;
- approving production samples and files yourself before a manufacturer, printer or supplier makes any quantity;
- confirming that the Product complies with every law, regulation, standard and certification requirement that applies wherever it is made, sold or used — for example product-safety, children's product, toy, food-contact, electrical, radio, chemical, labelling, packaging and recycling rules — and obtaining any testing, certification, marking, warnings and instructions it needs;
- confirming that it does not infringe anyone's patent, design right, trademark, copyright, trade dress or other right.
11. Your Products are your responsibility
As between you and Bric, you are the designer, maker and — if you sell or distribute it — the seller of every Product, and you are solely responsible for it and for everything that results from it, including:
- its intended use, and how it is described and marketed;
- the choice of materials, printer, manufacturing process and settings;
- tolerances and fit;
- fasteners, adhesives, Third-Party Components and electrical components;
- assembly and installation;
- testing, and any failure to test;
- warnings, instructions, packaging and labelling;
- compliance, testing and certification;
- its design, quality, safety, performance, durability and fitness for purpose, and any defect, failure or inaccuracy, including one caused by an error in an Output;
- wasted or rejected prints, prototypes, batches or production runs; materials, tooling, moulds, machine time, shipping, storage and inventory; and the cost of reworking, recalling, replacing or destroying Products;
- recalls, regulatory enquiries, fines and penalties;
- injury, illness, death, or damage to property caused by or connected with it, to you or to anyone else; and
- every warranty, guarantee, representation or promise you give about it, and every claim by your customers, users, distributors, retailers, marketplaces or anyone else.
If you sell, distribute or give away a Product, it is your commercial product. You assume responsibility for it toward your customers, its users and everyone else downstream, and you must not state or suggest that Bric designed, engineered, tested, approved, certified or stands behind it. This section applies subject only to mandatory law that cannot be changed by agreement.
12. Safety-Critical Characteristics and High-Risk Uses
Bric is not designed, qualified or intended to determine or validate any Safety-Critical Characteristic, and it does not do so — including where it generates the geometry of a Product that has one, or runs an Automated Check on it. You must not rely on the Service or any Output as the sole or authoritative means of determining any Safety-Critical Characteristic, including:
- structural or load capacity, where failure could cause serious injury;
- medical safety or clinical performance;
- the performance of personal protective equipment;
- life-safety performance, such as that of climbing, fall-protection, restraint or child-safety products;
- electrical safety;
- pressure safety;
- fire safety;
- food-contact or chemical safety;
- vehicle-critical safety; or
- any characteristic that the law requires to be tested or certified.
Before you make, distribute or use any Product for a High-Risk Use, you must have its Safety-Critical Characteristics independently assessed by a suitably qualified professional, and tested and certified wherever the law or good practice requires. Using an Output for a High-Risk Use without doing so breaches these Terms and is entirely at your own risk. Sections 10, 11 and 21 to 24 apply to every High-Risk Use in full.
This section does not stop you from using the Service to create ordinary objects, such as furniture, lamps, housings, enclosures, pet products and household items. It places responsibility for their Safety-Critical Characteristics on you.
13. Prohibited uses
You must not use the Service, or any Output, to:
- design, make or help make any weapon, firearm, firearm part or accessory, ammunition, explosive or suppressor, or any object designed to injure or harm people or animals, or to restrain people against their will, or to get around a law about any of them;
- design, make or help make any product that is illegal where it is made, sold or used;
- make counterfeit, knock-off or infringing goods, or copy another person's product, brand, logo, character, artwork or design without their permission;
- do anything unlawful, fraudulent, deceptive, defamatory, harassing, hateful or obscene, or anything that violates anyone's privacy or other rights;
- upload another person's personal information, or images of an identifiable person, without their consent;
- state or suggest that an Output or Product was made by a human professional, was designed, engineered, tested, certified or approved by Bric, or meets a standard it has not been independently confirmed to meet;
- copy, scrape, harvest or bulk-download the Service, its templates or other users' content, or use any robot, script or automated means to access it except through features we provide for that purpose;
- use the Service or its Outputs to build, train or improve a competing product or AI model;
- reverse-engineer, decompile or try to extract the source code, models, prompts or underlying systems of the Service, except where the law expressly allows it despite this restriction;
- get around, disable or interfere with any limit, credit, security or access control, or any acknowledgement the Service asks for, or try to reach any account, system or data you are not permitted to reach;
- introduce malware, overload or disrupt the Service, or act in a way that could harm Bric, its providers or its users;
- break any export-control or sanctions law, or the usage policies of the AI providers the Service relies on.
14. Acknowledgements and records
Bric may ask you to read and acknowledge notices about risk and responsibility — for example before Bric builds an Output, or before you first export, download or use particular Outputs — and may withhold or decline to build an Output until you do. Each acknowledgement adds to these Terms and does not narrow them.
Some notices concern particular hazards that Bric looks for in a request, such as heat, contact with food or drink, small parts and young children, hot places, or items mounted on walls or overhead. Bric looks only for a fixed and limited set of hazard types, using automated software that can miss them. A hazard notice is general information, not a safety assessment: a Product may have hazards that no notice mentions, the absence of a notice does not mean a Product is safe, and the precautions a notice suggests may not be enough. Seeing or acknowledging a notice does not reduce your responsibilities under sections 10 to 12.
Bric may create and keep records that evidence your relationship with us and your use of the Service, including: acceptance of these Terms and any Feature Terms, and the versions accepted; acknowledgements of warnings and notices, the hazards or notices shown, and the version and fingerprint of their wording; export and download confirmations; project, version and Output identifiers; timestamps; file identifiers and file hashes; and other compliance, security and audit events. We may keep these records for as long as reasonably necessary for compliance, security, fraud prevention, enforcing these Terms, resolving disputes, and establishing, exercising or defending legal claims, including product-liability claims — including after the project or account concerned is deleted. You agree that these records may be used as evidence of what they record.
15. Your Content and the licence you give
You keep whatever ownership you have in Your Content. You promise that you have every right needed to provide Your Content and to grant the licence below, and that it, and our use of it as these Terms allow, does not infringe or violate anyone's rights or any law.
You grant Bric a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable (through multiple tiers) and transferable licence to host, store, copy, process, transmit, display, analyse, adapt, modify and create derivative works of Your Content and your Outputs, as needed to operate, provide, secure and support the Service; to evaluate, test, develop and improve the Service and Bric's systems, models, prompts, instructions and Automated Checks; to comply with law; and to enforce these Terms. Sublicensees may use Your Content and Outputs only to provide services to Bric or for the purposes in this section. This licence continues for as long as we hold Your Content, and afterwards for the copies and records we keep as described in section 14 and in our Privacy Policy. It covers every build attempt, and your answers and photos about what you made.
We may combine information from many users, such as print results, into statistics that do not identify anyone. Those statistics belong to Bric, and we may keep and use them for any purpose, including after your project or account is deleted.
You are solely responsible for Your Content. We do not have to review it, but we may, and we may remove or refuse any of it, at any time, for any reason.
16. No confidential or professional relationship
Submitting material to the Service — including an invention, a product idea or a confidential commercial concept — does not by itself create a fiduciary relationship, a non-disclosure agreement, a professional duty of confidentiality, or any implied relationship of confidence between you and Bric. Bric's obligations about Your Content are those set out in these Terms, those imposed by applicable law (including data-protection law), and those in any separate written agreement, such as a non-disclosure or enterprise agreement, signed by Bric. Our Privacy Policy describes how we handle personal information.
If you need stronger protection for an idea — for example because you intend to apply for a patent or keep it as a trade secret — take professional advice, and do not submit it unless you are content for it to be handled as these Terms and the Privacy Policy describe.
17. Outputs, ownership and intellectual property
As between you and Bric, and to the extent we have any rights in the Outputs generated for you, we assign them to you, subject to your compliance with these Terms and to the licence in section 15. You may use your Outputs, and make, use and sell Products, for any lawful purpose, including commercially, at your own risk and subject to these Terms.
We make no promise that Outputs are original or unique, that anyone owns them, that they can be protected by copyright, patent, design right or trademark, or that they do not infringe anyone else's rights. Other users may receive similar or identical Outputs. The law on the ownership of AI-generated material is unsettled and differs between countries. It is your responsibility to clear the rights you need before relying on or commercialising an Output or a Product.
Templates and other material provided by Bric, or published by other users, are licensed to you only as stated where they are offered, including in the Publishing Terms. Bric does not check templates for accuracy, safety, originality or rights; you use them at your own risk, and they are Outputs for the purposes of these Terms. If you publish a project, the Publishing Terms apply to it.
18. Intellectual-property complaints and removal
You must not use the Service to infringe anyone's intellectual property. If you believe that material available through the Service — Your Content, an Output, a project or a published Template — infringes your copyright, trademark, design right, patent or other intellectual-property right, send a notice to our designated agent for intellectual-property complaints: Copyright Agent, RGHL Brands Pte. Ltd., trading as Bric Lab, hello@briclab.com. A copyright notice must include:
- your physical or electronic signature;
- identification of the work or right you say is infringed and, for a registered right, its registration number;
- identification of the material you say infringes, with information reasonably sufficient for us to find it, such as a link to the project or Template;
- your name, postal address, telephone number and email address;
- a statement that you believe in good faith that the use is not authorised by the rights owner, its agent or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the rights owner or are authorised to act for the owner.
Notices about other rights, such as trademarks, design rights and patents, should include the same information as far as it applies. We may not act on a notice that does not substantially include it. Under US law, a person who knowingly and materially misrepresents that material infringes may be liable for damages. We may share a notice, including its sender's name and contact details, with the user concerned.
We may remove or disable access to any material, decline to generate, build or publish anything, and suspend or close any account, at any time and without notice, if we receive a complaint or believe in good faith that material may infringe or violate anyone's intellectual-property or other rights, or where the law requires it. We do not have to decide whether a complaint is valid before acting, and we are not liable to you for anything we remove, disable or decline in good faith. We may also decline requests that appear designed to copy another person's product, brand, logo or character.
If material you provided was removed because of a copyright notice and you believe that happened because of a mistake or misidentification, you may send a counter-notice to the same address. It must include your physical or electronic signature; identification of the material and where it appeared before removal; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the federal court for the district where your address is (or, if you are outside the United States, any judicial district in which Bric may be found) and will accept service from the person who sent the original notice. Where US copyright law requires it, we will restore the material 10 to 14 business days after receiving a valid counter-notice, unless the person who sent the original notice tells us they have started a court action. We may share a counter-notice with that person.
In appropriate circumstances, we will disable or close the accounts of users who repeatedly infringe intellectual-property rights.
19. Credits and payments
Some features use credits. During testing, credits are a free promotional allowance. Credits have no cash or monetary value; they are not money, property, a deposit or a stored-value instrument; and they cannot be bought back, refunded, sold, transferred, exchanged or redeemed for cash, goods or services outside the Service.
We set, and may change at any time, how many credits you receive, what each action costs, and when credits expire. We may correct a balance that is wrong, and withdraw credits obtained by mistake, by abuse or in breach of these Terms. Unused credits are lost when your account ends.
If we introduce paid plans or purchases, the price, billing and refund terms will be shown to you before you pay and will form part of these Terms. Unless those terms or the law say otherwise, all payments are non-refundable.
20. Third-party services, sources and makers
The Service relies on third-party providers, including AI model providers, hosting and storage providers, and web sources it looks things up in. It may show links to, or information from, other websites, products, printers, manufacturers or suppliers. We do not control, check, endorse or take responsibility for any of them, their content, their products or their services, or for any dealings you have with them. Any agreement you make with a printer, manufacturer, supplier or other third party is between you and them alone.
21. No warranties
THE SERVICE, ALL OUTPUTS, AUTOMATED CHECKS, TEMPLATES, CREDITS AND EVERYTHING ELSE PROVIDED THROUGH IT ARE PROVIDED "AS IS", "AS AVAILABLE" AND "WITH ALL FAULTS", AND YOUR USE OF THEM IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, BRIC DISCLAIMS ALL WARRANTIES, CONDITIONS AND REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SAFETY, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE ABOVE, BRIC DOES NOT WARRANT THAT ANY OUTPUT IS ACCURATE, COMPLETE, RELIABLE, SAFE, LAWFUL, ORIGINAL OR NON-INFRINGING; THAT ANY AUTOMATED CHECK IS CORRECT OR COMPLETE; THAT ANY OBJECT CAN BE PRINTED, MANUFACTURED, ASSEMBLED OR USED; THAT IT WILL WORK, FIT, BEAR ANY LOAD OR LAST; THAT IT MEETS ANY LAW, STANDARD, CERTIFICATION OR SPECIFICATION; OR THAT THE SERVICE WILL MEET YOUR NEEDS OR BE AVAILABLE, SECURE OR ERROR-FREE. NO ADVICE, INFORMATION OR LABEL FROM BRIC OR THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS. THIS SECTION IS SUBJECT TO THE LAST PARAGRAPH OF SECTION 23.
22. Your assumption of risk
You understand that designing, printing, making, assembling, handling, using and selling physical objects carries real risks, including risks from 3D printers and other machines (heat, burns, fumes and fine particles, moving parts, electrical faults and fire), from tools, materials and Third-Party Components, and from the objects themselves (sharp edges, breakage, collapse, small parts, choking, allergic or chemical reactions). TO THE FULLEST EXTENT PERMITTED BY LAW, YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL OF THESE RISKS, AND ALL RISKS OF RELYING ON ANY OUTPUT OR AUTOMATED CHECK, for yourself and for anyone to whom you provide a Product or file.
23. Limits on our liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BRIC BE LIABLE TO YOU OR ANYONE ELSE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, SALES, BUSINESS, GOODWILL, REPUTATION, DATA OR OPPORTUNITY, OR COSTS OF SUBSTITUTE GOODS OR SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, BRIC WILL NOT BE LIABLE FOR ANY LOSS, DAMAGE, COST OR CLAIM ARISING OUT OF OR RELATING TO ANY PRODUCT OR THIRD-PARTY COMPONENT, INCLUDING WASTED, DEFECTIVE OR REJECTED PRINTS, PROTOTYPES, BATCHES OR PRODUCTION RUNS; MATERIALS, TOOLING, MACHINE TIME, INVENTORY, SHIPPING OR STORAGE; RECALLS, REWORK, REPLACEMENT OR DESTRUCTION; REGULATORY ACTION, FINES OR PENALTIES; CLAIMS BY YOUR CUSTOMERS OR OTHER THIRD PARTIES; OR PERSONAL INJURY, DEATH OR PROPERTY DAMAGE CAUSED BY OR CONNECTED WITH ANY PRODUCT.
TO THE FULLEST EXTENT PERMITTED BY LAW, BRIC'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, ANY FEATURE TERMS OR THE SERVICE, TOGETHER, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID BRIC IN MONEY FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE FIRST CLAIM, AND (B) ONE HUNDRED US DOLLARS (US$100). THIS IS A SINGLE AGGREGATE LIMIT SHARED BY THESE TERMS AND ALL FEATURE TERMS; IT IS NOT MULTIPLIED BY THE NUMBER OF CLAIMS, DOCUMENTS OR FEATURES.
THESE LIMITS APPLY TO EVERY THEORY OF LIABILITY — CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT OR PRODUCT LIABILITY, MISREPRESENTATION, BREACH OF STATUTORY DUTY OR OTHERWISE — EVEN IF BRIC WAS TOLD OF THE POSSIBILITY OF THE LOSS AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THEY ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND BRIC; WITHOUT THEM WE WOULD NOT OFFER THE SERVICE.
Nothing in these Terms excludes or limits liability to the extent applicable law prohibits that liability from being excluded or limited, including, where applicable, liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under consumer-protection law that cannot be waived. Where such law applies, the exclusions and limits in these Terms apply to the maximum extent that law allows, and no further.
24. Indemnity and release
To the fullest extent permitted by applicable law, you agree to defend, indemnify and hold harmless Bric from and against any and all claims, demands, actions, investigations, losses, liabilities, damages, judgments, settlements, fines, penalties, costs and expenses (including reasonable legal and expert fees) arising out of or relating to:
- any Product, including its design, making, testing, labelling, marketing, sale, distribution, installation or use;
- the commercialisation of any Product, and any claim by your customers, users, distributors, retailers, marketplaces or other downstream parties;
- injury, illness, death or damage to property connected with any Product;
- any recall, regulatory enquiry or enforcement action connected with any Product;
- any claim that a Product, Your Content or your use of an Output infringes or violates anyone's intellectual property or other rights;
- any Third-Party Component, and any printer, manufacturer, supplier or other third party you deal with;
- any warranty, guarantee, representation or promise you make about a Product;
- your failure to verify, test or obtain professional review of an Output or Product as these Terms require;
- your use or misuse of the Service or any Output, Your Content, and your breach of these Terms or of any law.
This indemnity applies even where the claim alleges negligence by Bric, except to the extent a court or arbitrator finally determines that the loss was caused by Bric's fraud, gross negligence or wilful misconduct, and except to the extent applicable law does not permit the liability concerned to be shifted to you.
We may take over the defence of any such claim at your expense, choose counsel, and control its settlement, and you will cooperate with us. You will not settle any claim that affects Bric without our prior written agreement.
To the fullest extent permitted by law, you release Bric from all claims, known and unknown, arising out of or relating to any Product or your reliance on any Output or Automated Check. If you are a California resident, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar law elsewhere.
25. Feedback
If you send us ideas, suggestions or feedback, you give us a perpetual, irrevocable, worldwide, royalty-free right to use them for any purpose, without any obligation to you.
26. Our rights, suspension and ending
The Service, including its software, models, prompts, designs, templates, trademarks and content other than Your Content, belongs to Bric and its licensors. We give you a limited, personal, revocable, non-exclusive, non-transferable licence to use the Service in line with these Terms. All other rights are reserved.
We may suspend or end your access, remove content, or change, limit or discontinue any part of the Service, at any time, for any reason or none, with or without notice, and without liability to you. You may stop using the Service at any time and ask us to close your account.
Sections 2, 4 to 25 and 27 to 29, this section other than the licence we give you, and any other terms that by their nature should, survive the end of these Terms and of your account.
27. Disputes: arbitration and class-action waiver
Informal resolution first. Before starting any claim, you and Bric each agree to try to resolve it informally by writing to the other with a description of the dispute and the relief sought. For you, that means writing to hello@briclab.com. If it is not resolved within 60 days, either party may start arbitration.
Binding individual arbitration. Except as set out below, any dispute, claim or controversy arising out of or relating to these Terms, any Feature Terms, the Service, any Output or any Product (a "Dispute") will be resolved by final and binding arbitration administered by the American Arbitration Association under its applicable rules, before a single arbitrator. The Federal Arbitration Act governs this section. The arbitrator decides all questions of scope, enforceability and arbitrability, except that a court decides any question about the class-action waiver or the mass-arbitration terms below. Judgment on the award may be entered in any court with jurisdiction.
No class actions and no jury. YOU AND BRIC EACH AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING, AND EACH WAIVES THE RIGHT TO A TRIAL BY JURY. The arbitrator may not consolidate claims of more than one person or award relief to anyone other than the individual party.
Mass filings. If 25 or more similar demands are filed by or with the help of the same or coordinated counsel, they will be administered in batches of up to 25, with one arbitrator per batch, and no further batch will be filed or administered until the previous batch is resolved; fees for each demand become payable only when its batch is administered.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek an injunction in court to protect its intellectual property or to stop misuse of the Service.
Opting out. You may opt out of this section 27 by emailing us within 30 days of first accepting these Terms, stating your name, the email address of your account and that you opt out of arbitration. If you opt out, or if this section is found unenforceable, Disputes will be decided only by the state and federal courts located in the State of Delaware, and you and Bric submit to their exclusive jurisdiction.
Time limit. To the fullest extent permitted by law, any Dispute must be started within one year after it arises, or it is permanently barred.
28. Governing law
These Terms and any Dispute, including non-contractual disputes and claims, are governed by the laws of the State of Delaware, United States, and applicable US federal law, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If you live outside the United States, you keep any rights given to you by the mandatory law of the place where you live that cannot be waived by agreement.
29. General
We may change these Terms at any time. The version number and publication date at the top of this page show which version applies and when it was published. We may tell you about a material change, for example in the Service or by email, and may ask you to accept it. By continuing to use the Service after a change takes effect, you accept the changed Terms. Changes do not apply to a Dispute already notified before the change.
These Terms, with any Feature Terms, are the entire agreement between you and Bric about the Service and replace any earlier understanding. The Privacy Policy is a notice of how we handle personal information and is not part of this agreement. Feature Terms add to these Terms. If they conflict, the Feature Terms govern that feature, except that nothing in any Feature Terms narrows or replaces sections 6 to 14, 21 to 24 or 27 of these Terms, which always apply in full; and the limit on our total liability in section 23 is a single limit for all claims together, including claims under any Feature Terms. If any part of these Terms is unenforceable, it will be enforced to the fullest extent possible and the rest remains in effect. Our failure to enforce a term is not a waiver of it.
You may not assign or transfer these Terms without our written consent; we may assign or transfer them without restriction, including as part of a merger, acquisition or sale of assets. No third party has any rights under these Terms, except that the people and companies included in "Bric" in section 1 may rely on the protections given to them. We are not liable for any failure or delay caused by events beyond our reasonable control. You agree that we may give you notices and agreements electronically. "Including" means "including without limitation". If these Terms are translated, the English version governs.
